Terms of service

Plain terms for a simple product. Using DropYourFiles means you agree to these; if something here does not work for you, write to us before you rely on the service.

The short version. Your work stays yours. We store it and deliver it and nothing else. You can leave at any time and take everything with you. We can suspend an account being used to break the law or to harm somebody.

What the service is

DropYourFiles is operated by Own The Light, in Dana Point, California. It lets a studio upload video and photographs, build a gallery, and send one link. The person who receives that link can watch, leave notes, mark favourites, approve the work and download the files, without making an account.

Studios sign in with an email address and password, or with Google. The optional Mac app uploads the files a studio chooses. A studio can also import files it picks from Dropbox or Google Drive; we copy only those files and keep no access to the rest.

Your account

Your content stays yours

You keep every right in the files you upload. You give us permission to store, process and transmit them only so far as running the service requires — encoding a video so it plays, making a thumbnail, sending the file to the person you sent the link to.

We do not use your files to train machine-learning models, we do not show them to anyone you have not sent a link to, and we do not put our branding on the page your client opens — on any plan, including the free one.

You are responsible for having the right to upload what you upload, including permission from anyone appearing in it.

Emails to your clients

We send your client the gallery link with your studio’s name as the sender. Save-your-files reminders, check-in emails and testimonial requests go out only if you turn them on for that client, and you can turn them off at any time. If a client asks you to stop emailing them, turn them off. You are responsible for having a reason to email the people you add.

What you may not do

We can suspend or close an account that does these things. Where it is safe and lawful to do so, we will tell you why first.

Plans, limits and payment

Ending it

You can close your account whenever you like. Before you do, download anything you want to keep — closing an account deletes the files in it, and the links you have sent will stop working. Ask us and we will confirm the deletion in writing.

If we ever have to close the service, we will give you notice and time to get your files out.

Availability

We work hard to keep this up and we do not promise it will never be down. The service is provided as it is, without warranties of any kind, to the extent the law allows.

Keep your own copy of your work. This is a delivery tool, not a backup. Your masters should exist somewhere else as well.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, or lost data. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.

Nothing here limits liability for anything that cannot lawfully be limited.

Changes

If we change these terms we will change the date at the top, and email accounts in good standing when a change is material. Carrying on using the service after that means you accept the new version.
